Terms and Conditions
Use of Premises
– The property shall be used for vacation purposes only.
– Maximum Occupancy: 7 individuals for MoonBud (160 Thorp Shores) and 8 individuals for LoonsNest (158 Thorp Shores).
– Guests exceeding these numbers will be asked to vacate without a refund.
Prohibited Activities
– No Unauthorized Parties or Events: Hosting parties or events on the property without prior approval is strictly prohibited.
– Registered Guests Only: Only guests listed in the booking are permitted to stay on the property. Contact the Owner for approval to add additional guests.
Security Deposit
– The security deposit will be returned within 7 days after check-out, provided there are no damages, excessive cleaning requirements, or violations of this agreement.
Cancellation Policy
– Full Refund: Cancellations made within 48 hours of booking if the check-in date is at least 60 days away.
– 50% Refund: Cancellations made 30 to 60 days prior to the rental period.
– No Refund: Cancellations within 30 days of the rental period.
Compliance with Maine Laws and Regulations
– The Guest agrees to comply with all applicable local, state, and federal laws, including the Maine Short-Term Rental Laws and Readfield’s local ordinances.
– Excessive Noise/Disruptive Behavior: Immediate termination of this agreement and removal from the premises without a refund.
– Fireworks: Strictly prohibited.
Pets
– Up to two pets are allowed only with prior written approval from the Owner.
– Additional cleaning fees apply.
Smoking
– Smoking (tobacco, marijuana, or e-cigarettes) is strictly prohibited on the property.
House Rules
Guests must abide by the attached House Rules (Exhibit A), including but not limited to:
– Fires must be contained in the designated fire pit.
– Swimming, kayaking, paddleboarding, and water activities are at the Guest’s own risk.
– Quiet hours: 10:00 PM to 7:00 AM.
Check-In/Check-Out
– Early check-in or late check-out may be available upon request.
– The property must be left in a clean and orderly condition upon check-out.
Damages and Liability
– The Guest is responsible for any damage to the property, its contents, or amenities caused by themselves or their guests.
– The Owner is not responsible for accidents, injuries, or illnesses occurring during the Guest’s stay.
Indemnification
– The Guest agrees to indemnify and hold harmless the Owner from any liabilities, theft, or damage to personal property.
Force Majeure
– The Owner shall not be liable for events beyond their control, such as natural disasters, pandemics, or other unforeseen circumstances that may affect the Guest’s stay.
Quiet Enjoyment
– Guests must behave in a civilized manner and respect the rights of neighbors.
– Excessive noise or disturbances will result in immediate termination of the agreement.
Trash Disposal
– Guests must dispose of all waste in designated garbage and recycling areas.
Subletting
– Subletting the property is strictly prohibited.
Amenities Provided
– The Owner will provide basic essentials, including towels, linens, and kitchenware. Guests are responsible for cleaning these items during their stay.
Owner’s Liability
– The Owner is not responsible for any loss of personal property. Guests are advised to purchase insurance if desired.
Attorney’s Fees
– Guests agree to pay reasonable attorney’s fees and costs incurred by the Owner in enforcing this agreement.
Governing Law
– This agreement shall be governed by the laws of the State of Maine. Disputes will be resolved in the courts of Kennebec County, Maine.
Additional Terms
– Any additional terms agreed upon by both parties will be attached as an addendum to this agreement.
